Family Law and Child Custody

A divorce is never pleasant, but it can become even less pleasant when there are children involved. The thing about children is that they will oftentimes not understand the divorce proceedings. To them, it will appear as if you and your spouse, or mommy and daddy are simply fighting. In some cases they will believe that they are at fault whether that is true or not. This is precisely why an uncontested divorce is the best way to go, but more importantly, you need to learn about family law and child custody which includes the laws behind child custody in your state.

First, you need to understand exactly what family law and child custody is and how it will affect your child. There are two different types of child custody, the first being family law joint custody. This indicates that the parents will take turns caring for the children, and while the children are in the care of their respective parent or guardian, that guardian will have full control over the child including the major medical decisions.

The second type of custody is legal custody. This is an event in which a single parent manages to gain sole control over the child.  There are a number of different reasons that a parent may gain this type of authority, but it is normally a result of the other parent being unfit. However, why would a parent be unfit? Under what circumstances could this be effectively declared?

The most common reasons would be the other parent being deemed too dangerous. Whether it is true or not, clear evidence may be presented to the court and once this evidence is given, it is very difficult to refute.  When it comes to family law and child custody, if one parent could put the child in danger, then the state will generally rule against them, and a few circumstances that could lead up to this:

-Unclean living conditions can often cause a problem. In cases such as this a mediator is called in and they will determine which parent provides the best living conditions. Once this is determined, and once a psych evaluation is successfully completed, the proper parent will be determined. The court will normally listen to the mediator, and if you can get them on your side, you will have a clear shot to home base.

-Negligent behavior might also be an issue. For instance, if a parent has had trouble taking their child to school repeatedly, this behavior might be considered harmful to the child.

These are a few examples under which a parent would lose a family court and child custody case.  If the above signs are clear in your partner, you should still do everything in your power to gain custody. It may appear as if you have a free ride, but it is not unheard of for the wrong parent to gain custody. Put everything you have into this fight, if not for you, then for the children.  This includes understanding everything you can about family law and child custody.  There is quite a bit of information that you need to know but in the end it’s all worth it.
